1. Introduction

These Terms of Service govern your use of kizera.com and your purchase of any products from us. Please read them carefully. By browsing this website, creating an account, or placing an order, you agree to these Terms.

If you do not agree to these Terms, please do not use this website.

Throughout these Terms, "Kizera", "we", "us", and "our" refer to Capture and Create trading as Kizera. "You" refers to the person using this website or placing an order.

We are a company registered in the Netherlands and we sell to customers in the United States. All prices are in US dollars and all returns are handled through our Lockport, New York facility.

3. Eligibility

To place an order you must be at least 18 years old and legally able to enter into a binding contract. By ordering, you confirm that you meet these requirements.

We sell to consumers for personal use. If you wish to purchase for resale or in commercial quantities, contact us first at support@kizera.com.

4. Your account

You can shop as a guest or create an account. If you create one, you are responsible for keeping your login details confidential and for all activity that takes place under your account.

Please tell us immediately at support@kizera.com if you believe your account has been accessed without your permission.

You agree to provide accurate, current, and complete information. We may suspend or close an account that contains false information or that is used in breach of these Terms.

5. Products and descriptions

We work hard to describe our products accurately, including materials, dimensions, and finishes.

Please note two things that are specific to home decor:

Color. Screens vary. The color of a product on your monitor or phone may differ slightly from the physical item. We photograph our products in natural light and avoid heavy editing, but we cannot guarantee exact color reproduction on your device.

Handmade and natural materials. Where a product is handmade or uses natural materials such as wood, stone, rattan, or ceramic, small variations in grain, tone, and texture are expected. These are characteristics of the material, not defects.

Dimensions listed on product pages are approximate and may vary by a small tolerance. If exact measurements matter for your space, email us before ordering and we will confirm.

Product availability is not guaranteed. Items may sell out after you add them to your cart.

6. Pricing and errors

All prices are shown in US dollars and exclude shipping and applicable sales tax. Your full total, including shipping and tax, is displayed at checkout before you confirm your order.

We reserve the right to change prices at any time. Price changes do not affect orders already confirmed.

Despite our efforts, a product may occasionally be listed at an incorrect price or with an incorrect description. If we discover an error in an order you have placed, we will contact you before shipping and give you the choice of proceeding at the correct price or cancelling for a full refund. We are not obliged to fulfill an order placed at a manifestly incorrect price.

7. Orders and contract formation

When you place an order you receive an automatic email confirming that we have received it. This confirmation is an acknowledgement, not an acceptance.

A contract between you and Kizera is formed when we send you a shipping confirmation email. Until that point we may decline or cancel your order.

We may refuse or cancel an order where:

• The item is out of stock or listed at an incorrect price
• We cannot verify your billing or shipping information
• The order is flagged as high risk by our fraud screening
• We reasonably believe the order breaches these Terms
• We are unable to ship to your address

If we cancel an order after payment has been taken, we refund the full amount.

8. Payment

Accepted payment methods, currency, billing descriptors, and foreign transaction fees are set out in our Payment Policy, which forms part of these Terms.

9. Shipping and delivery

Delivery estimates, costs, and carrier information are set out in our Shipping Policy, which forms part of these Terms.

Delivery timeframes are estimates and are not guaranteed. In line with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule, if we cannot ship within the timeframe stated at checkout, or within 30 days where none is stated, we will notify you and give you the option to accept the delay or cancel for a full refund.

Risk of loss passes to you when the carrier delivers the item to the address you provided. If your item arrives damaged, Section 4 of our Refund and Return Policy applies and we will replace or refund it at no cost to you.

10. Returns and refunds

Your return rights, the 30 day window, and the refund process are set out in our Refund and Return Policy, which forms part of these Terms.

11. Reviews and customer content

If you submit a review, photograph, comment, or other content to our website or social channels, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with Kizera. You confirm that the content is yours to share and does not infringe anyone else's rights.

Our commitment on reviews. We publish customer reviews as they are submitted. We do not write reviews ourselves, pay for reviews, offer compensation in exchange for positive reviews, or suppress reviews because they are critical. We may remove content that is unlawful, abusive, off topic, contains personal data, or is submitted by someone who did not purchase the product.

We may edit reviews only to remove profanity or personal information, never to change the substance of the opinion.

12. Intellectual property

All content on kizera.com, including text, product photography, graphics, layout, and the Kizera name and logo, is owned by us or licensed to us and is protected by copyright and trademark law.

You may view and print content for your own personal, non-commercial use. You may not copy, reproduce, republish, or use our content for commercial purposes without our written permission.

13. Acceptable use

You agree not to:

• Use this website for any unlawful or fraudulent purpose
• Attempt to gain unauthorized access to our systems or another user's account
• Introduce malware or any code intended to disrupt the website
• Scrape, mine, or systematically extract data from the website
• Place orders using false details or another person's payment method
• Resell our products in a way that misrepresents your relationship with Kizera

We may suspend or block access to anyone who breaches this section.

14. Third party links

Our website may link to third party sites. We provide these links for convenience only. We do not control those sites and are not responsible for their content, products, or privacy practices.

15. Disclaimer of warranties

We provide this website and its content on an "as is" and "as available" basis. We do not warrant that the website will be uninterrupted, error free, or free of harmful components.

To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose.

Some states do not allow the exclusion of implied warranties. If you live in such a state, the exclusions above may not apply to you, and you may have additional rights. Nothing in these Terms limits any warranty or right that cannot be limited under applicable law.

16. Limitation of liability

To the fullest extent permitted by law, Kizera is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of data, arising from your use of this website or your purchase of our products.

Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in this section limits our liability for fraud, for death or personal injury caused by our negligence, or for any other liability that cannot be limited under applicable law. Some states do not allow certain limitations of liability, so parts of this section may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Kizera and Capture and Create, and our officers and employees, from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your misuse of the website.

18. Governing law and jurisdiction

These Terms and any dispute arising from them are governed by the laws of the State of New York, without regard to its conflict of law rules.

This choice of law does not deprive you of the protection of any mandatory consumer protection law of the state in which you reside. Where the law of your home state gives you rights that cannot be waived, those rights continue to apply.

19. Dispute resolution

Talk to us first. If you have a problem, email support@kizera.com. We respond within 1 business day and resolve almost every issue directly. Before starting any formal proceeding, you agree to give us 30 days from the date you notify us in writing to resolve the matter informally.

20. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, extreme weather, strikes, carrier disruption, customs delays, war, civil unrest, epidemic, or failure of utilities or telecommunications networks.

Where such an event causes a significant delay, we will notify you and offer you the choice to wait or cancel for a full refund.

21. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order. We update the date at the top whenever we make a change.

Continued use of the website after a change means you accept the revised Terms.

22. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, that provision is severed and the remaining provisions continue in full effect.

These Terms, together with our Payment Policy, Shipping Policy, Refund and Return Policy, and Privacy Policy, form the entire agreement between you and Kizera regarding your use of this website.

Our failure to enforce any provision is not a waiver of our right to enforce it later.
